# Is professional indemnity insurance mandatory for mental health clinicians in Kenya?

**Answer:** It depends on the regulator. Section 15A of the Medical Practitioners and Dentists Act requires every KMPDC-registered practitioner, including psychiatrists, to hold professional indemnity cover each year, and every licensed health institution to insure against its staff's professional liability. No equivalent mandatory requirement was confirmed for counsellors and psychologists under their Act, or for nurses and social workers. Many employers and contracts require cover anyway, so check your regulator, employer and contracts.
