**Answer:** Yes. The Digital Health (Health Information Management Procedures) Regulations 2025 say a healthcare provider or health facility must not use a digital health solution to provide care unless the Digital Health Agency has certified it. The definition covers electronic health records, telehealth systems and health apps. Certification involves proof of registration with the ODPC, security and privacy policies, and the ability to exchange data with the national system. Ask vendors for their certification status and check it with the Agency.
